Corepunk Preorder Agreement

IMPORTANT NOTICE:


BEFORE YOU CAN PLACE A PRE-ORDER FOR THE EARLY ACCESS TO THE COREPUNK GAME VERSION "COREPUNK: LIGHT BLESS THE KING", YOU MUST: (I) AGREE TO THIS PREORDER AGREEMENT; (II) PROVIDE CONSENT TO PROCESS DATA ACCORDING THE PRIVACY AND COOKIE POLICY; (III) PAY THE PREORDER FEE.


YOU SHOULD CAREFULLY READ THIS PREORDER AGREEMENT (THE “AGREEMENT”) AND THE PRIVACY AND COOKIE POLICY BEFORE PLACING A PREORDER AND MAKING PAYMENT.


PREORDERING EARLY ACCESS TO THE COREPUNK GAME MEANS IT IS LICENSED, NOT SOLD.


TO ENTER INTO THIS AGREEMENT, YOU MUST BE AT LEAST 18 YEARS OLD. YOU ARE LEGALLY AND FINANCIALLY RESPONSIBLE FOR ALL ACTIONS RELATED TO PLACING THE ORDER, PAYING FOR THE PREORDER, AND USING OR ACCESSING OUR EARLY ACCESS TO THE COREPUNK GAME, INCLUDING THE ACTIONS OF ANYONE YOU ALLOW TO ACCESS YOUR ACCOUNT. YOU AFFIRM THAT YOU UNDERSTAND AND ACCEPT THIS AGREEMENT (INCLUDING ITS DISPUTE RESOLUTION TERMS).


BY TICKING THE BOX AND/OR PLACING A PREORDER AND/OR MAKING PAYMENT, YOU HEREBY CONFIRM THAT YOU ARE AT LEAST 18 YEARS OLD AND ACCEPT THE TERMS OF THIS AGREEMENT, AS WELL AS THE PRIVACY AND COOKIE POLICY.


IF YOU ARE UNDER 18 YEARS OLD AND/OR DO NOT AGREE WITH ALL OF THE TERMS OF THIS AGREEMENT AND THE PRIVACY AND COOKIE POLICY, YOU MAY NOT PLACE A PREORDER. ANY PREORDER PLACED IN VIOLATION OF THE PRECEDING SENTENCE IS VOID AND INVALID.


1. Parties
This Preorder Agreement is a legal agreement (general terms and conditions) between 
1.1 Us:  
COREPUNK B.V., a Dutch company, registered under number 69946868, with a registered office at Jan van Galenstraat 335, 1061 AZ Amsterdam, the Netherlands, in respect of preorders placed by customers, acceptance and check of preorders and payments (hereinafter referred to as “we” or “us”).
and
1.2 You:  
A natural person ordering Early access to the COREPUNK GAME in accordance with this Agreement (hereinafter referred to as “you,” “yours,” or “customer”).




2. Definitions
2.1. "COREPUNK GAME" means the online computer video game as a service (GaaS) named “Corepunk” in version "Corepunk: Light Bless the King," which includes the IP-Right protected front-end and back-end computer code (as well as object code and source code), game engine, the infrastructure for scaling, configured scripts and instructions for further automatic deployment, listings, algorithms, diagrams, graphs, (enriched) data, calculations, development and test versions, adjustments, changes, expansions, modifications (updates and upgrades), and all associated (technical and/or user) documentation and corresponding (preparatory) materials; images, pictures, photographs, locations, structural or landscape designs, titles, logos, trade or service marks, insignia, designs, graphics, user interfaces, visual interfaces, sound effects, video effects, audio-visual effects, animation, sounds, music, musical compositions, recordings, vocals, voices, narrations, themes, concepts, stories, and storylines, texts, messages, plot, characters (including but not limited to the names, likenesses, inventories, and catchy phrases of game characters), virtual goods (including but not limited to digital cards, currency, potions, weapons, armor, wearable items, skins, sprays, pets, mounts, etc.), software, technology, tools, methods of operation, related documentation, products, files, information, all data and communications generated by or occurring through the game, demos, promotional materials, audiovisual and/or multimedia works, style, all recordings, game replays (or reenactments of in-game matches, battles, duels, etc.) and/or any other artwork and original works of authorship, as well as the structure, selection, coordination, expression, "look and feel," and arrangement of such objects, as well as objects that are protected by copyrights, trademark rights, patent rights, design rights, trade name rights, database rights and related rights, as well as domain names, know-how, in electronic form or otherwise, all this in the broadest sense, whether protected by IP Rights or otherwise, any updates and upgrades that replace or supplement the COREPUNK GAME that are not distributed with a separate license, the associated media, any software associated with the online mode of the video game, any printed materials, any online or electronic documentation, game server applications, game launcher and client applications, and any and all copies of such software and materials.
2.2. “Early access to the COREPUNK GAME” means early access to the COREPUNK GAME that is not finished or fully developed, not released, is still being developed, contains bugs, errors, will have interruptions, may be shut down for days, weeks or longer, and may have access only at a scheduled time.
2.3. “Preorder” is an order placed for Early access to the COREPUNK GAME in version "Corepunk: Light Bless the King" that hasn't been released to the public or is not currently available to the public.
2.4. “Preorder Agreement” or “Agreement” means this preorder agreement, which is the set of general terms and conditions that governs your and our rights and obligations regarding the preorder for early access to the COREPUNK GAME.
2.5. “Customer Support Email” refers to the following:

2.6. “Preorder Fee” means the sum of money that a customer pays for a Preorder.
2.7. “Delivery Date” means November 2024, which is the indicative month of planned availability to customers and/or release of Early Access to the COREPUNK GAME.
2.8. “Website” means our official website https://corepunk.com.
2.9. “IP-Right” means all intellectual property rights (including where relevant moral and proprietary rights) and rights associated therewith, such as copyright, trademark rights, patent rights, model rights, trade name rights, database rights, trade secrets, and related rights, as well as rights to know-how and performances on a par with such rights (eenlijnsprestaties) or a patentable invention. IP-Right also includes all foreseeable, unforeseeable, current, and future methods for making commercial use of the aforementioned rights, as well as the right to claim compensation.


3. Preorder: What Exactly You Order
3.1. By placing and paying for a Preorder, you acknowledge and understand that in the future you will have the right to receive Early access to the COREPUNK GAME in the version "COREPUNK: Light Bless the King" based on a separate agreement. After the release of the COREPUNK GAME, you will have access to the COREPUNK GAME in the version "COREPUNK: Light Bless the King". 
3.2. You acknowledge, understand, and accept that you are placing a Preorder at a stage when detailed specifications and features of Early access to the COREPUNK GAME and the COREPUNK GAME have not yet been determined. The only specifications of the Early access to the COREPUNK GAME are described on our Website and are indicative; they may change and be different from what is described on the Website and our official social network pages. The COREPUNK GAME is still in the development stage, so we can definitely change something to improve your experience. By agreeing to the Agreement and placing a Preorder, you represent and warrant to us that you understand that the Early access to the COREPUNK GAME and the COREPUNK GAME configuration may change before the execution of the Early access agreement (license agreement).
3.3. WE WILL STRIVE TO PROVIDE A GOOD WORKING EARLY ACCESS TO THE COREPUNK GAME. HOWEVER, YOU DO REALIZE AND HEREBY CONFIRM THAT THE EARLY ACCESS TO THE COREPUNK GAME WILL HAVE BUGS AND ERRORS, IS NOT FINISHED OR FULLY DEVELOPED, NOT RELEASED, IS STILL BEING DEVELOPED, WILL HAVE INTERRUPTIONS, AND MAY BE SHUT DOWN FOR DAYS OR WEEKS. ACCESS MAY BE AVAILABLE ONLY AT SCHEDULED TIMES. ALL IN-GAME PROGRESS, LEVELS, AND MECHANICS MAY BE RESET, CHANGED, OR DELETED, AND YOU MAY LOSE YOUR SCORES, GAME PROGRESS, ETC.
3.4. BY PLACING A PREORDER AND/OR MAKING PAYMENT FOR THE PREORDER, YOU HEREBY CONFIRM THAT YOU REALIZE AND ACCEPT THAT YOU WILL NEED TO ACCEPT THE EARLY ACCESS AGREEMENT (LICENSE AGREEMENT), WHICH WILL BE AVAILABLE TO YOU BEFORE YOU RECEIVE YOUR ACTUAL EARLY ACCESS TO THE COREPUNK GAME. We will make it available to you before providing Early access to the COREPUNK GAME.
3.5. IN ANY CASE, THE PREORDER, EARLY ACCESS TO THE COREPUNK GAME, AND THE COREPUNK GAME WILL BE LICENSED, NOT SOLD.
3.6. Each Preorder you submit for Early access acts as a deposit for a future purchase and license agreement for Early access to the COREPUNK GAME. You are under no obligation to purchase or obtain a license to the COREPUNK GAME from us at this stage, and we are under no obligation to supply you with Early access to the COREPUNK GAME and/or the COREPUNK GAME at this stage.
3.7. We will have fulfilled our obligations under this Preorder Agreement upon making early Access available to you under the terms and conditions of the separate agreement for Early access to the COREPUNK GAME via the email address registered to your account when placing the Preorder.


4. Preorder Reservation Process
4.1. Preorders shall be placed on the Website.
4.2. When placing a Preorder, you will be required to provide certain billing information. You represent and warrant that all such information is accurate, and you shall ensure that such information is kept current. We shall have no responsibility or liability for inaccurate information or information that later becomes outdated. You can update your information at any time before the announcement and provision of early access to the COREPUNK GAME by sending an email to our Customer Support Email.
4.3. Payment of the Preorder Fee does not guarantee acceptance of your Preorder. Preorders are completed when payment is approved by our payment provider and you have received a confirmation email from us.
4.4. You acknowledge and agree that we may reject your Preorder for any reason and at any time at our discretion; we may also decline or delay Preorders in general to avoid oversubscription or as deemed appropriate by us. We will make efforts to inform you by email about rejection or decline within two (2) weeks of our receipt of your Preorder, and you will be entitled to a full refund of the Preorder Fee within 14 days after our rejection or decline.
4.5. If you have a question, comment, or concern regarding the Preorder, please contact us by sending an email to the Customer Support Email.


5. Price and Payment for Preorder
5.1. You will be charged the Preorder Fee indicated on the Website when you place your Preorder using the payment methods we offer via our payment providers. After you purchase the Preorder, you will not need to pay more for Early Access and the released COREPUNK GAME. 
5.2. The Preorder Fee includes all taxes and other charges.
5.3. Placing a Preorder constitutes your express agreement to be charged the Preorder Fee using the provided payment method.
5.4. The price for the Preorder will depend on the Preorder pack you choose. The Preorder pack includes Early access to the COREPUNK GAME in version "Corepunk: Light Bless the King '', as well as Preorder bonuses described on the Website, and the released COREPUNK GAME in the version “Corepunk: Light Bless the King”. The rules for obtaining specific bonuses will be described on the Website.
5.5. The price for the preorder will vary based on your region (country) of residence. In the event of a refund, the refunded amount will be adjusted according to the exchange rate effective on the date of the refund, in accordance with the payment provider's terms and conditions. Please note that the payment provider may charge additional fees if the payment is made in currencies other than Euros.


6. No Guarantee of Delivery Date
6.1. You are preordering a digital product (Early access to the COREPUNK GAME) that is still in the development stage and will be developed in the future.
6.2. We strive to provide you with Early access to the COREPUNK GAME by the Delivery Date under the terms of this Preorder Agreement. We may announce changes to the Delivery Date on our Website and will do our best to meet this new Delivery Date, as well as keep you informed about any changes in the Delivery Date. However, you do acknowledge and accept that the Delivery Date is solely an indicative month of planned availability to you and other customers and/or the release of early access to the COREPUNK GAME. The actual date for the availability and release of early access to the COREPUNK GAME depends on various factors and may change with or without notice to you. Please follow our Website for any updates on this matter.
6.3. You acknowledge and accept that we are not responsible for any damages that may occur due to the delay of the Early access to the COREPUNK GAME, nor shall we be obligated, except as set forth in this Agreement, to provide any discounts, additional refunds, or credits due to any such delays. If for any reason you decide that you do not wish to continue to wait for your Early access to the COREPUNK GAME, you may cancel your Preorder as provided for in Section 7 below.


7. Cancellation and Refund
7.1. You can cancel your Preorder and receive a full refund at any time up until Early access to the COREPUNK GAME is made available to download or access.
7.1.1. You have the right to withdraw from the Preorder and Early access to the COREPUNK GAME for any reason until the Early access to the COREPUNK GAME and Early access agreement (and license agreement) is available for you to download or access. After this event, you hereby acknowledge that you lose your right of withdrawal from the Preorder or Early access to the COREPUNK GAME and your right to a refund for the Preorder. However, you will still have the right to accept the Early access terms, pay the price difference (if any), and receive your early access.
7.1.2. If for any reason cl. 7.1.1 is not applicable to you based on the legislation, then this cl. 7.1.2 should apply. Once the Early access to the COREPUNK GAME is made available for you to download or access, you have the right to withdraw from the Preorder, Early access to the COREPUNK GAME, and from accepting the Early access agreement (and license agreement) within fourteen (14) calendar days for any reason. Your right to withdraw starts from the day after the Early access to the COREPUNK GAME is available to download or access as announced on the Website. After this term, you hereby acknowledge that you lose your right of withdrawal from the Preorder or Early access to the COREPUNK GAME and your right to a refund for the Preorder. However, you will still have the right to accept the Early access terms, pay the price difference (if any), and receive your early access.
7.1.3. In any case, you hereby acknowledge that you lose your right of withdrawal from Preorder or Early Access to the COREPUNK GAME once the performance of the Early Access to the COREPUNK GAME has begun and you have played Early Access for 2 (two) hours and more. 
7.2. To exercise the right of withdrawal, you should send an email to the Customer Support Email from the email address you used to make the Preorder and include the following:
“I hereby give notice that I withdraw from my Preorder Agreement of the Early access to the COREPUNK GAME: ordering date:____, order number:____.“
We may request additional information to identify you and proceed with the refund. You will receive your refund within approximately 14 (fourteen) business days.
7.3. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
7.4. We reserve the right to cancel your or all Preorders by terminating this Agreement or by announcement on the Website at any time for any or no reason before our notice to you that the Early Access to the COREPUNK GAME is available and will refund you in full. We may request additional information to identify you and proceed with the refund. You will receive your refund within approximately 14 (fourteen) business days after our notification. 
7.5. Chargebacks: All chargebacks for Preorder will be investigated thoroughly. Any fraudulent chargebacks will be contested, and we reserve the right to take legal action to recover the disputed amount.
7.6. Account Security: Customers are responsible for maintaining the security of their accounts and for all activities that occur under their account. Any unauthorized use or breach of account security must be reported immediately to our Customer Support Email.
7.7. Payment Information: Orders with invalid or fraudulent payment information will be automatically canceled and reported to the relevant authorities. We reserve the right to cancel Preorder or terminate account at our discretion if fraudulent activity is detected.
7.8. Excessive Cancellations and Refunds: Excessive cancellations and refund requests may result in account suspension, investigation, or both. We reserve the right to limit or refuse refund requests if abuse is suspected.
7.9. Automated Systems: The use of automated systems, including bots, to place Preorders is strictly prohibited. Any orders placed using such systems will be canceled, and we reserve the right to take legal action against individuals or entities employing such systems.
7.10. False Claims: False claims of non-receipt or defectiveness will be investigated. Customers found making false claims may be banned from future purchases, and legal action may be taken to recover any losses incurred due to such claims.


8. Limitations of Liability
8.1. THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION WILL NOT LIMIT OR EXCLUDE LIABILITY FOR THE GROSS NEGLIGENCE, INTENTIONAL MISCONDUCT OR FRAUD FROM OUR SIDE.
8.2. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, YOU EXPRESSLY AGREE THAT PLACING THE PREORDER IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO DELIVERY DATE, SATISFACTORY QUALITY AND/OR PERFORMANCE OF THE EARLY ACCESS TO THE COREPUNK GAME, DELAYS, CANCELLATIONS OF THE EARLY ACCESS TO THE COREPUNK GAME IS WITH YOU.
8.3. THE EARLY ACCESS TO THE COREPUNK GAME AND GAME ACCOUNT WILL BE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS FOR USE, WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, AND WE HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE EARLY ACCESS TO THE COREPUNK GAME, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF CONDITION, UNINTERRUPTED OR ERROR-FREE USE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. 
8.4. WE MAKE NO WARRANTY THAT THE EARLY ACCESS TO THE COREPUNK GAME (A) WILL MEET YOUR REQUIREMENTS, (B) WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (C) WILL BE INTEROPERABLE OR COMPATIBLE WITH OTHER SOFTWARE, OR (D) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE EARLY ACCESS TO THE COREPUNK GAME WILL BE EFFECTIVE, ACCURATE OR RELIABLE, OR (D) THAT THE EARLY ACCESS TO THE COREPUNK GAME WILL NOT DAMAGE ANY OTHER SOFTWARE, HARDWARE OR DATA, (E) THAT ANY SOFTWARE, NETWORK SERVICES (INCLUDING THE INTERNET) OR PRODUCTS (OTHER THAN THE EARLY ACCESS TO THE COREPUNK GAME) UPON WHICH THE EARLY ACCESS TO THE COREPUNK GAME`S PERFORMANCE DEPENDS WILL CONTINUE TO BE AVAILABLE, UNINTERRUPTED OR UNMODIFIED, AND (F) REGARDING THE USE OR THE RESULTS OF THE USE OF THE EARLY ACCESS TO THE COREPUNK GAME IN TERMS OF ITS CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.
8.5. YOU ACKNOWLEDGE AND AGREE THAT YOUR EXCLUSIVE REMEDY FOR ANY DISPUTE WITH US IS TO CANCEL THE PREORDER. IN NO CASE SHALL ANY LIABILITY OF US TO YOU EXCEED THE AMOUNT THAT YOU PAID TO US OR ITS AFFILIATES AND/OR DESIGNEES DURING THE SIX (6) MONTHS BEFORE THE TIME YOUR CAUSE OF ACTION AROSE FOR THE APPLICABLE PREORDER GIVING RISE TO ANY SUCH LIABILITY. IN NO EVENT SHALL WE OR OUR AFFILIATES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY SPECIAL, PUNITIVE, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND ON ANY THEORY OF LIABILITY, ARISING OUT OF OR IN CONNECTION WITH THE PREORDER OR USE OF THE EARLY ACCESS TO THE COREPUNK GAME, INCLUDING DAMAGES TO PROPERTY, LOSS OF GOODWILL, COMPUTER FAILURE OR MALFUNCTION AND, TO THE EXTENT PERMITTED BY LAW, DAMAGES FOR PERSONAL INJURIES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW. 
8.6. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY US OR OUR EMPLOYEES OR REPRESENTATIVES SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF OUR OBLIGATIONS AND/ OR LIABILITY.


9. Privacy and Cookie Policy 
We describe policies related to our collection and use of data in our Privacy and Cookie Policy https://corepunk.com/en/privacy or https://shop.corepunk.com/pages/policies, which is incorporated by reference. Please read our Privacy and Cookie Policy carefully to understand the data that we collect our practices regarding your information and how it will be treated. If you do not agree with the Privacy and Cookie Policy, you shall not place a Preorder. If you have any questions or concerns regarding your privacy, please contact us via Customer Support Email.


10. Modification
We reserve the right, at our discretion, to change this Preorder Agreement on a going-forward basis at any time. Please check this Preorder Agreement periodically for changes. If a change to this Preorder Agreement materially modifies your rights or obligations, you will be required to accept the modified Preorder Agreement for your Preorder to remain valid. Material modifications are effective upon your acceptance of the modified Preorder Agreement. Immaterial modifications are effective upon publication. Disputes arising under this Preorder Agreement will be resolved by the version of this Preorder Agreement that was in effect at the time the dispute arose.


11. Dispute resolution and governing law
11.1. To expedite resolution and control the cost of any dispute, controversy, or claim related to this Agreement (“Dispute”), you and we agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least thirty (30) days before initiating any court proceeding. Such informal negotiations commence upon written notice from one person to the other. We will send our notice to the email address you have provided to us. You will send your notice to the addresses mentioned in the Contact details. 
11.2. This Agreement will be governed by the laws of the Netherlands. This Agreement shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded. By agreeing to this Agreement, in the event of any claim you may have arising from or related to the Preorder or this Agreement you agree to the exclusive personal and subject matter jurisdiction of the courts located in Amsterdam, the Netherlands, for making and resolving any such claims, and hereby waive any right to participate in any type of lawsuit brought and/or maintained as a class action or similar in nature to a class action. We reserve the right to make any claim against you and seek and be granted any legal or equitable remedy against you in any court anywhere in the world.
11.3. Attorneys' Fees. In the event any litigation is brought by either party in connection with the Agreement, the prevailing party in such litigation shall be entitled to recover from the other party all the reasonable costs, attorneys' fees, and other expenses incurred by such prevailing party in the litigation insofar permitted under the law.


12. Other terms
12.1. Assignment. We may assign this Agreement in whole or in part, to any person or entity at any time with and without your consent or notification. You may not assign the Agreement without our prior written consent and any unauthorized assignment by you shall be null and void.
12.2. Entire Agreement.  This Agreement and Privacy and Cookie Policy, each as amended and modified from time to time, together constitute the entire agreement between you and us with respect to the Preorder, and supersedes all prior or contemporaneous communications, whether electronic, oral, or written, between you and us with respect to the Preorder; provided, however, that this Agreement shall coexist with Privacy and Cookie policies and other policies, terms and conditions, rules and guidelines published by us. 
12.3. No Waiver. The failure by us to enforce any right or provision of the Agreement will not constitute a waiver of future enforcement of that right or provision. The waiver of any right or provision will be effective only if in writing and signed by our duly authorized representative.
12.4. Severability. If any part of this Agreement is held invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible so as to maintain the intent of this Agreement, and the other parts will remain in full force and effect. 
12.5. Force Majeure. We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including without limitation any failure to perform hereunder due to unforeseen circumstances or cause beyond our control such as acts of God, war, terrorism, pandemics, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, power outages, circumstances caused by suppliers or shortages of transportation facilities, fuel, energy, labor or materials.

(a) If to us. All notices given by you or required under the Agreement shall be in writing and addressed to COREPUNK B.V., a Dutch company, to the following address Jan van Galenstraat 335, 1061 AZ Amsterdam, the Netherlands.

(b) If to You. All notices given by us under this Agreement shall be given to you either through written notice, email, or website blog post.
12.7. The provisions of Sections 8 “Limitations of Liability”, 11 “Dispute resolution and governing law”, 12 “Other terms” shall survive termination of this Agreement for any reason.
