END-USER LICENSE AGREEMENT FOR WONDERDRAFT This End-User License Agreement (EULA) is a legal agreement between you (either as an individual or on behalf of an entity) and Tailwind Games, LLC regarding your use of Wonderdraft for Windows, Linux, and MacOS and associated documentation (the "SOFTWARE"). IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS EULA, DO NOT INSTALL, USE OR COPY THE SOFTWARE. By downloading, installing, using, or copying the SOFTWARE, you accept and agree to be bound by the terms of this EULA. If you do not agree to all of the terms of this EULA, you may not download, install, use or copy the SOFTWARE. This EULA constitutes the entire agreement between you and Tailwind Games and governs your use of the SOFTWARE, superseding any prior agreements between you and Tailwind Games (including, but not limited to, any prior versions of the EULA). SUMMARY 1. You must agree to all of the terms of this EULA to use this SOFTWARE. 2. By agreeing to the terms, you may use validly licensed copies of this SOFTWARE . 3. This SOFTWARE is provided "as-is" with no warranties, and Tailwind Games is not liable for anything. 4. For commercial or business use, you must obtain one license for every user who operates the SOFTWARE. GRANT OF LICENSE 1. If you use the SOFTWARE for personal, non-commercial purposes, this EULA entitles you to install as many copies of the SOFTWARE as you want, and use the SOFTWARE for any lawful purpose consistent with this EULA. 2. If you use the SOFTWARE for commercial purposes, this EULA entitles you to install and operate one copy of the SOFTWARE for any lawful purpose consistent with this EULA. 3. Your license to use the SOFTWARE is expressly conditioned upon your agreement to all of the terms of this EULA. 4. This SOFTWARE is licensed, not sold. RESTRICTIONS 1. When using the SOFTWARE you must use it in a manner that complies with the applicable laws in the jurisdiction(s) in which you use the SOFTWARE. 2. You may not sell, resell, rent, lease, or exchange the SOFTWARE for anything of value. 3. You may not redistribute, repackage, or bundle the SOFTWARE with any other SOFTWARE. 4. You may not remove or alter any proprietary notices or marks on the SOFTWARE. 5. You may not reverse engineer, decompile, or disassemble the SOFTWARE, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation. TERMINATION Without prejudice to any other rights, Tailwind Games may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE and all of its component parts. COPYRIGHT AND TRADEMARKS The SOFTWARE and all worldwide copyrights, trade secrets, and other intellectual property rights therein are the exclusive property of Tailwind Games. Tailwind Games reserves all other rights not granted by this EULA. The names Wonderdraft, Megasploot, and Tailwind Games are trademarks of Tailwind Games. You agree not to display or use these trademarks in any manner without Tailwind Games's prior, written permission. LIMITATIONS ON LIABILITY Tailwind Games expressly disclaims any warranty for the SOFTWARE. The SOFTWARE and any related documentation is provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or noninfringement. The entire risk arising out of use or performance of the SOFTWARE remains with you. Tailwind Games does not warrant or assume responsibility for the accuracy or completeness of any information, text, graphics, links or other items contained within the SOFTWARE. In no event shall the author of this SOFTWARE be liable for any special, consequential, incidental or indirect damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this SOFTWARE, even if the Tailwind Games is aware of the possibility of such damages and known defects.
