Contributor License Agreement (CLA) Thank you for your interest in contributing to the Abysner open-source software project. This Contributor License Agreement ("Agreement") sets forth the terms under which you ("You" or "Contributor") contribute any work of authorship, including but not limited to source code, documentation, data, resources, or any other work protected by authorship ("Contributions") to Abysner ("Project"), owned by NeoTech (R.R. Smit), the Project Owner ("Owner"). This Agreement ensures that: - The Owner receives all rights necessary to use and distribute the Contributions under both open-source and commercial licenses. - The Contributor is protected from liabilities. - The Owner is not obligated to use the Contributions. - The Contributor has no obligation to provide maintenance, bug fixes, or support. By agreeing to this CLA, You accept the following terms for any Contributions You make to the Project: 1. Grant of Rights You hereby grant the Owner a perpetual, worldwide, non-exclusive, royalty-free, and transferable license to: - Use, reproduce, modify, prepare derivative works of, publicly display, publicly perform, and distribute your Contributions, whether in original or modified form, in whole or in part. - Sublicense, relicense, and transfer the foregoing rights to third parties, at the Owner’s discretion. You also grant the Owner a patent license, allowing the Owner to make, use, sell, and distribute your Contributions, including the right to sublicense these patent rights to others. 2. Contributor Representations By agreeing to this CLA, You represent and warrant the following: - Your Contributions are your original work and have not been copied from any third party, unless you have obtained the necessary rights to contribute such work. - You have full legal authority to grant the rights described in this Agreement, including the rights to the copyright and patent licenses. - You have the right to submit your Contributions and that such Contributions do not infringe or violate the intellectual property rights of others. - If your Contributions were created as part of your employment, you represent that you have obtained the necessary permission from your employer to contribute such work to this Project. You further represent that you are not violating any obligations to your employer or any intellectual property rights agreements in making these Contributions. 3. No Contributor Obligations - You are under no obligation to provide support, bug fixes, or ongoing maintenance for your Contributions, whether in response to issues raised by the Owner or others. - The Owner is under no obligation to use, incorporate, or distribute your Contributions, or to incorporate them into any subsequent versions of the Project. 4. Disclaimer - Your Contributions are provided "as-is", without any warranties or representations of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. - The Owner shall not be liable for any damages, claims, or losses arising from the use of the Contributions, whether direct or indirect.
