# END USER LICENSE AGREEMENT FOR OFFICIAL BINARIES **Version 1.1** **Effective Date:** August 1st 2026 (1.08.2026) Copyright 2026 Radomir Kukla. All rights reserved. This End User License Agreement (EULA) is a legally binding agreement between Radomir Kukla (Licensor) and the individual or legal entity obtaining or using the Official Binaries (User). By downloading, installing, accessing, purchasing, launching, or otherwise using the Official Binaries, the User agrees to be bound by this EULA. If the User does not agree to these terms, the User must not install, access, or use the Official Binaries. --- ## 1. Definitions ### 1.1. Official Binaries "Official Binaries" means any pre-compiled binary, executable, installer, application package, archive, update, patch, downloadable build, or other compiled version of the Software that is distributed or expressly authorized by the Licensor, including versions distributed through: - Steam; - itch.io; - the Licensor's official website; - an authorized application store; - an authorized distributor; or - another distribution channel expressly approved by the Licensor. A binary compiled by a third party from publicly available Source Code is not an Official Binary unless the Licensor expressly designates it as such in writing. ### 1.2. Software "Software" means the computer program identified as RiverFlow, including its Official Binaries and any documentation, updates, or accompanying materials provided by the Licensor. ### 1.3. Authorized Platform "Authorized Platform" means a device, account, storefront, organization, or technical environment through which the User lawfully obtained the Official Binaries. ### 1.4. Source Code "Source Code" has the meaning given in the applicable source-code license governing the publicly available source repository, if any. --- ## 2. Grant of License Subject to the User's continued compliance with this EULA and payment of any applicable purchase price, the Licensor grants the User a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the Official Binaries for their intended purpose. Unless otherwise stated by the Licensor or the relevant authorized distributor, the license is granted solely to the purchasing individual or organization. The Official Binaries are licensed, not sold. The User receives no ownership interest in the Software or the Official Binaries. --- ## 3. Permitted Use The User may: 1. install and execute the Official Binaries on devices owned or controlled by the User, subject to any applicable platform or storefront limits; 2. make temporary technical copies automatically created as part of normal installation, execution, backup, or system operation; 3. use functionality made available through the ordinary user interface of the Official Binaries; and 4. make one reasonable archival backup copy, where permitted by applicable law and the applicable distribution platform. --- ## 4. Restrictions Except where expressly permitted by this EULA or required by mandatory applicable law, the User may not: 1. copy, reproduce, redistribute, publish, upload, host, transmit, share, rent, lease, lend, sell, resell, sublicense, assign, or otherwise provide the Official Binaries to any third party; 2. make the Official Binaries available through a public or private download service, file-sharing service, mirror, repository, torrent, cloud drive, server, or similar system; 3. circumvent, remove, disable, bypass, interfere with, or defeat any access control, licensing mechanism, digital rights management system, authentication system, or technical protection measure; 4. reverse engineer, decompile, disassemble, decode, translate, or otherwise attempt to derive the source code, internal structure, algorithms, or non-public interfaces of the Official Binaries; 5. modify, patch, adapt, alter, or create derivative works from the Official Binaries; 6. remove, obscure, or modify any copyright, trademark, authorship, attribution, license, or proprietary-rights notice; 7. use the Official Binaries to create, train, validate, or improve a competing product by extracting protected source code, assets, or other copyrighted elements; 8. falsely represent a modified, unofficial, or third-party build as an official release of the Licensor; or 9. use the Official Binaries in violation of applicable law. Nothing in this EULA excludes or limits any act that applicable mandatory law expressly permits notwithstanding a contractual restriction, including any non-waivable rights relating to interoperability, security testing, backup copies, or software analysis. For avoidance of doubt, this EULA does not grant any right to extract, derive, reconstruct, or disclose the Source Code from the Official Binaries except to the extent mandatory law expressly permits such activity. --- ## 5. Source Code The Source Code, if made publicly available, is not licensed under this EULA. Use, modification, compilation, and distribution of the Source Code are governed separately by the applicable source-code license, or by another source-code license expressly identified by the Licensor. Possession of or access to the Source Code does not grant the User a right to redistribute the Official Binaries. Likewise, purchasing or obtaining the Official Binaries does not grant any rights to use the Source Code beyond those separately provided under the applicable source-code license. --- ## 6. User-Created Content and Modifications Where the Software expressly supports mods, plug-ins, user-created content, configuration files, or other extensions, the Licensor may provide separate rules governing such materials. Permission to create or use supported modifications does not include permission to redistribute the Official Binaries or any substantial portion of them. The Licensor does not claim ownership of independently created User content merely because it is used with the Software. However, the User remains responsible for ensuring that such content does not infringe third-party rights or violate applicable law. --- ## 7. Ownership and Intellectual Property The Software, Official Binaries, original audiovisual materials, code, documentation, names, logos, and other protected elements are owned by the Licensor or the relevant third-party rights holders. All rights not expressly granted under this EULA are reserved. This EULA does not grant the User any license to use the Licensor's trademarks, trade names, logos, branding, product names, or visual identity except as necessary to truthfully identify the Software. --- ## 8. Third-Party Components The Software may include third-party libraries, assets, tools, or components governed by separate license terms. Those third-party components remain governed solely by their own licenses. If a third-party license grants the User rights that conflict with a restriction in this EULA, the third-party license controls only with respect to that third-party component. Required third-party notices, where applicable, shall be provided in the Software, its documentation, or an accompanying notices file. Nothing in this EULA is intended to override a separate license that applies to a clearly identified third-party component. --- ## 9. Updates and Changes The Licensor may provide updates, patches, fixes, modifications, or additional content. Unless accompanied by separate terms, such updates form part of the Official Binaries and are governed by this EULA. The Licensor may modify this EULA for future versions or distributions of the Software. A change shall not retroactively remove rights already granted for a version lawfully obtained under an earlier agreement unless: 1. the User expressly accepts the amended terms; 2. the change is required by law; or 3. the relevant right was conditional and the User materially breached the applicable agreement. --- ## 10. Termination This EULA remains effective until terminated. The User's rights under this EULA terminate automatically if the User materially breaches its terms and fails to remedy the breach within fourteen days after receiving notice, where the breach is capable of remedy. Immediate termination may occur where the breach involves deliberate piracy, unauthorized commercial redistribution, circumvention of technical protection measures, or conduct causing substantial and irreparable harm. Upon termination, the User must cease using and delete all copies of the Official Binaries in the User's possession or control, except where retention is required by law. Termination does not affect rights and obligations that, by their nature, should survive termination, including ownership, disclaimers, limitation of liability, and claims arising from an earlier breach. --- ## 11. Disclaimer of Warranty To the fullest extent permitted by applicable law, the Software is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory. The Licensor does not warrant that the Software will: - be uninterrupted, secure, or error-free; - meet every User requirement; - be compatible with every device, operating system, driver, or third-party service; - preserve all data under every circumstance; or - remain available indefinitely. Nothing in this section excludes warranties, consumer protections, remedies, or statutory rights that cannot lawfully be excluded or limited. --- ## 12. Limitation of Liability To the fullest extent permitted by applicable law, the Licensor shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, or for loss of profits, revenue, goodwill, business opportunity, anticipated savings, or data, arising from or relating to the Software. Where liability cannot be excluded entirely, the Licensor's aggregate contractual liability shall be limited to the amount paid by the User for the relevant Official Binaries during the twelve months preceding the event giving rise to the claim. The limitations in this section do not apply where liability cannot lawfully be excluded or limited, including liability resulting from intentional misconduct, or any other liability subject to mandatory law. --- ## 13. Consumer Rights Nothing in this EULA limits any mandatory rights available to consumers under applicable law, including the laws of the European Union and the User's country of habitual residence. Where this EULA conflicts with a non-waivable consumer right, that mandatory right prevails to the extent of the conflict. --- ## 14. Export and Legal Compliance The User must comply with applicable export-control, sanctions, and trade laws. The User may not use, export, or transfer the Software where doing so would violate applicable law. --- ## 15. Governing Law and Jurisdiction This EULA is governed by the laws of the Republic of Poland, excluding its conflict-of-laws rules. For Users acting as businesses, any dispute arising out of or relating to this EULA shall be submitted to the courts having territorial jurisdiction for the Licensor's principal place of business. For consumers, this section does not deprive the User of the protection of mandatory provisions of the law of the country in which the User has their habitual residence or of any court jurisdiction available under mandatory consumer law. --- ## 16. Severability If any provision of this EULA is held invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent lawfully possible or, where necessary, severed. The remaining provisions shall remain in effect. --- ## 17. No Waiver A failure or delay by the Licensor to enforce any provision does not waive the right to enforce that provision or any other provision later. --- ## 18. Entire Agreement This EULA constitutes the entire agreement concerning the Official Binaries, except for: - mandatory applicable law; - separate written commercial agreements; - applicable storefront or distribution-platform terms; and - separate licenses governing third-party components. --- ## 19.
