State Taxation & Finance Commissioner Arthur J. Roth will hold an open meeting on
Tuesday, November 9, 1999 at 9:00 a.m. at his office, second floor, Building 9, State
Campus, Albany, New York. The Commissioner will consider the following regulations:
- Emergency adoption and proposal of amendments to the Cigarette Tax regulations to
implement requirements imposed upon the Department of Taxation and Finance by provisions
of the Tobacco Escrow Funds Act.
- Proposed amendments to the Fuel Use Tax regulations to set the sales tax component and
the composite rate per gallon of the Fuel Use Tax on motor fuel and diesel motor fuel for
the first quarter of 2000. This proposal also reflects the aggregate rate per gallon
for purposes of the joint administration of the Fuel Use Tax and Article 13-A carrier tax.
- Proposed amendments to Section 19-2.3 of the Franchise Tax on Banking Corporations
regulations to eliminate the requirement that a taxpayer making the election to use the
International Banking Facility (IBF) formula allocation method must do so within 45 days
of the beginning of the current taxable year.
- Approval and issuance, pursuant to Section 204 of the State Administrative Procedure
Act, of a declaratory ruling regarding whether a mortgage recording tax is due on the
recording of a modification and extension agreement relating to a previously recorded
credit line mortgage.
