Gewährte Rechte 2.1. Einsicht in den Quellcode Sie dürfen den Quellcode der Software lesen, inspizieren und zu Zwecken des Verständnisses, der Evaluierung und der internen Nutzung studieren. 2.2. Interne Nutzung Sie dürfen die Software innerhalb Ihrer eigenen Organisation unentgeltlich nutzen, um interne Analysen, Auswertungen oder Berichte (z. B. Business Reports, PDF-Reports) zu erstellen, sofern diese Ergebnisse ausschließlich für interne Zwecke verwendet werden. 3. Einschränkungen Sofern Sie keine individuelle, schriftliche kommerzielle Lizenz von SVEN HERRMANN erworben haben, ist Ihnen Folgendes ausdrücklich UNTERSAGT: 3.1. Kommerzielle Nutzung der Software Sie dürfen die Software nicht für kommerzielle Zwecke einsetzen. Insbesondere dürfen Sie die Software nicht: a) als Teil eines bezahlten Produkts oder Dienstes anbieten, b) in eine SaaS-, Cloud- oder Plattformlösung integrieren, die Dritten (entgeltlich oder im Rahmen eines kommerziellen Angebots) zur Verfügung gestellt wird, c) als technische Grundlage für ein Konkurrenzprodukt oder ein anderes kommerzielles Werkzeug verwenden. 3.2. Kommerzielle Nutzung der mit der Software erzeugten Ergebnisse Sie dürfen die mit der Software erzeugten Ergebnisse (z. B. Reports, PDFs, Analysen) nicht dazu verwenden, a) diese Ergebnisse an Dritte zu verkaufen oder gegen Entgelt anzubieten, b) diese Ergebnisse im Rahmen von bezahlten Dienstleistungen für Kunden zu erstellen (z. B. als Reporting-Dienstleister, Agentur oder Berater), c) diese Ergebnisse als Bestandteil eines kommerziellen Produkts oder Dienstes zu nutzen. Zulässig ist lediglich die interne Nutzung der Ergebnisse innerhalb Ihrer eigenen Organisation. 3.3. Weitergabe und Unterlizenzierung Sie dürfen die Software ohne schriftliche Zustimmung von [AUTOR/IN] nicht: a) kopieren, veröffentlichen oder an Dritte weitergeben, b) verbreiten, vermieten, verleasen oder anderweitig zur Verfügung stellen, c) unterlizenzieren oder Dritten Nutzungsrechte einräumen. 3.4. Modifikation und abgeleitete Werke Sie dürfen die Software nicht modifizieren, bearbeiten oder abgeleitete Werke erstellen, die Sie Dritten zugänglich machen, verbreiten oder kommerziell nutzen, es sei denn, Sie verfügen über eine schriftliche Vereinbarung mit `Sven Herrmann`, die dies ausdrücklich erlaubt. Interne Anpassungen für den eigenen Gebrauch sind nur zulässig, sofern die angepasste Software ausschließlich intern verwendet wird und weder die angepasste Software noch ihre Ergebnisse kommerziell im Sinne von Abschnitt 3.1 oder 3.2 genutzt werden. 4. Individuelle kommerzielle Lizenz Wenn Sie die Software oder ihre Ergebnisse kommerziell nutzen möchten (z. Kein Anspruch auf Open-Source-Lizenz SVEN HERRMANN kann in Zukunft beschließen, die Software ganz oder teilweise unter einer Open-Source-Lizenz zu veröffentlichen. Es besteht jedoch kein Rechtsanspruch darauf, dass eine solche Umstellung erfolgt oder zu einem bestimmten Zeitpunkt stattfindet. 6. Laufzeit und Beendigung Diese Lizenz tritt mit dem ersten Herunterladen, Installieren oder Verwenden der Software in Kraft und gilt bis zu ihrer Beendigung. Source Code Access You may read and inspect the source code of the Software and study it for the purposes of understanding, evaluation and internal use. 2.2. Internal Use You may use the Software within your own organization free of charge to create internal analyses, evaluations or reports (for example business reports, PDF reports), provided that such results are used exclusively for internal purposes. 3. Restrictions Unless you have obtained an individual, written commercial license from SVEN HERRMANN, you are expressly PROHIBITED from doing the following: 3.1. Commercial use of the Software You may not use the Software for commercial purposes. In particular, you may not: a) offer the Software as part of a paid product or service, b) integrate the Software into a SaaS, cloud or platform solution that is made available to third parties (whether for payment or as part of a commercial offering), c) use the Software as the technical basis for a competing product or any other commercial tool. 3.2. Commercial use of results produced by the Software You may not use results produced by the Software (for example reports, PDFs, analyses) in order to: a) sell these results to third parties or offer them for payment, b) create such results as part of paid services for clients (for example as a reporting provider, agency or consultant), c) use these results as part of a commercial product or service. Only internal use of results within your own organization is permitted. 3.3. Distribution and sublicensing Without the prior written consent of SVEN HERRMANN, you may not: a) copy, publish or distribute the Software to third parties, b) distribute, rent, lease or otherwise make the Software available, c) sublicense or grant usage rights to third parties. 3.4. Modification and derivative works You may not modify or edit the Software or create derivative works that you make available to third parties, distribute or use commercially, unless you have a written agreement with SVEN HERRMANN that expressly permits this. Internal adaptations for your own use are permitted only if the adapted Software is used exclusively internally and neither the adapted Software nor its results are used commercially within the meaning of Sections 3.1 or 3.2. 4. In the event of termination, you must: a) immediately cease using the Software, and b) destroy or permanently delete all copies of the Software and any derived internal versions. Provisions which by their nature are intended to survive termination (including but not limited to Sections 3, 6 and 7) shall remain in effect.
