# Gold Detector Terms of Service **Effective Date:** April 21, 2026 These Terms of Service ("Terms") govern your access to and use of the Gold Detector Discord application and related services (the "Service"), operated by **congenial-acorn** ("we," "us," or "our"). By installing, accessing, or using Gold Detector, you agree to these Terms. ## 1. What Gold Detector Is Gold Detector is a Discord bot for the game *Elite: Dangerous*. It monitors publicly available market-related information from third-party sources, including Inara.cz, and delivers alerts to Discord servers and users through Discord. Gold Detector is an independent community tool. It is not affiliated with, endorsed by, or sponsored by Frontier Developments, *Elite: Dangerous*, Inara.cz, Discord, or any related company or community project. ## 2. Eligibility You may use the Service only if you are permitted to use Discord under Discord's own terms and applicable law. By using the Service, you represent that you are legally permitted to do so. ## 3. Your Use of the Service You agree to use the Service lawfully and responsibly. You may not: - use the Service to violate any law or regulation; - interfere with or disrupt the Service; - attempt to gain unauthorized access to the Service or its underlying systems; - use automation, abuse, spam, or other conduct that unreasonably burdens the Service; - impersonate another person or misrepresent your relationship to a server, group, or community; - use the Service in a way that violates Discord's terms, policies, or community rules. If you use the Service in a Discord server, you are responsible for ensuring that your use is permitted by that server's administrators and rules. ## 4. Server and User Controls Gold Detector includes commands that allow users and server administrators to manage certain bot behavior, including alert subscriptions, alert channels, ping settings, and server opt-out settings. You are responsible for using those controls appropriately. Server administrators are responsible for configuration choices made for their servers. ## 5. Third-Party Platforms and Sources The Service operates through Discord and may rely on public information from third-party sources such as Inara.cz. We do not control those third-party services and are not responsible for their availability, accuracy, policies, or content. Your use of Discord and any third-party service remains subject to that third party's own terms and policies. ## 6. Availability, Accuracy, and Changes We try to keep Gold Detector available and useful, but we do not guarantee that: - the Service will always be available; - alerts will always be accurate, complete, timely, or error-free; - third-party data sources will remain accessible or consistent; - any particular feature will continue to exist. We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice. ## 7. No Paid Services Gold Detector is currently provided without paid subscriptions, purchases, or billing through the Service itself. If that changes in the future, additional terms may apply. ## 8. Privacy Your use of the Service is also governed by the Gold Detector Privacy Policy. By using the Service, you acknowledge that we may collect, use, and store certain information as described there. ## 9. Suspension and Termination We may restrict, suspend, or terminate access to the Service at any time, with or without notice, if we believe it is necessary to: - protect the Service, users, servers, or infrastructure; - respond to abuse, misuse, legal concerns, or technical issues; - comply with platform requirements or third-party obligations. You may stop using the Service at any time. Server administrators may remove the bot from their servers at any time. Individual users may stop DM alerts by using the relevant bot commands. ## 10. Intellectual Property Unless otherwise stated, the software, bot logic, formatting, and related materials we provide as part of the Service are owned by us or licensed to us. The game names, trademarks, and third-party platform names referenced by the Service remain the property of their respective owners. ## 11. Disclaimer of Warranties THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, accurate, or free from bugs, delays, or errors. ## 12. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONGENIAL-ACORN AND ITS OPERATORS, CONTRIBUTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, BUSINESS OPPORTUNITY, OR USE, ARISING OUT OF OR RELATING TO THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. ## 13. Indemnity To the extent permitted by law, you agree to indemnify and hold harmless congenial-acorn from claims, liabilities, damages, losses, and expenses arising out of or related to: - your use of the Service; - your violation of these Terms; - your violation of applicable law or third-party rights. ## 14. Governing Law These Terms are governed by the laws of the United States and the state in which the operator resides, without regard to conflict-of-law rules, except where applicable law requires otherwise. Any dispute arising out of or relating to these Terms or the Service shall be brought in the courts with proper jurisdiction in that state or in the United States, unless applicable law provides otherwise. ## 15. Changes to These Terms We may update these Terms from time to time. If we make material changes, we may provide notice through the bot, a support server, a repository, or another reasonable channel. The updated Terms will become effective when posted unless a later date is stated. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the updated Terms. ## 16.
