BLOCKSHIPS NON-COMMERCIAL LICENSE v1.0 Copyright (c) 2025 def9a2a4 https://github.com/def9a2a4/BlockShips THIS LICENSE AGREEMENT ("AGREEMENT") IS BETWEEN YOU ("YOU") AND THE COPYRIGHT HOLDER IDENTIFIED ABOVE ("DEVELOPER"). BY INSTALLING, COPYING, ACCESSING, OR USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THIS AGREEMENT. 1. DEFINITIONS 1.0 "You" means the individual or legal entity that installs, copies, accesses, uses, modifies, or distributes the Software, and includes any person acting on that individual's or entity's behalf. 1.1 "Software" means the software made available by Developer at: https://github.com/def9a2a4/BlockShips including without limitation all source code, binaries, assets, build files, documentation, configuration files, examples, and any updates, patches, or modifications made available by Developer at that location. 1.2 "Modify" means to alter, adapt, translate, refactor, optimize, patch, or create derivative works of the Software, in whole or in part. 1.3 "Server" means any instance, deployment, or service that hosts, emulates, or provides a Minecraft multiplayer server environment on which the Software is installed, loaded, executed, accessed, or used to provide functionality to players, including without limitation any server software derived from, based on, compatible with, or implementing the network protocol or functionality of the original Minecraft server software distributed by Mojang Studios and/or Microsoft (including any version thereof), and any forks, derivatives, or compatible implementations, whether known or later developed, including without limitation Paper, Spigot, Bukkit, Purpur, Fabric, Forge, NeoForge, Sponge, Velocity, BungeeCord, Waterfall, and any similar proxy, wrapper, or compatibility layer, together with any related infrastructure that directly supports gameplay access (including proxies and backend nodes). 1.4 "Commercial Server" means any Server (or the operation of any Server) for which any person or entity receives, seeks to receive, or reasonably expects to receive any money, revenue, financial benefit, consideration, or other material advantage that is directly or indirectly connected to the Server, its access, its community, its operation, or the gameplay experience. Without limiting the foregoing, a Server is a Commercial Server if any of the following apply, whether now or at any time during the period of use of the Software: (a) Access is sold, licensed, paid for, or otherwise gated by payment or consideration (including queues, whitelisting, or events); (b) The operator solicits or receives donations, tips, subscriptions, patronage, or "support" for the Server or its costs, regardless of whether perks are provided; (c) The operator sells or offers in-game items, ranks, cosmetics, perks, or any gameplay-related benefit, including "donation perks" or preferential treatment; (d) The Server or its community is sponsored, advertised, promoted for pay, or otherwise monetized (including ads, sponsors, affiliate links, or paid partnerships) in a way connected to the Server; (e) The Server is operated by, for, or in connection with a business, brand, organization, or revenue-generating project (including where the Server functions as marketing, community-building, lead generation, or brand engagement); (f) The Software is used to provide services to third parties for a fee, including hosting, managed services, resale, bundling, consulting, or operation on behalf of another party; (g) Any officer, owner, staff member, contractor, or operator is paid or otherwise compensated in connection with the Server's operation; (h) The Server is connected to, participates in, or interoperates with any multi-server network, cluster, proxy network, hub-and-spoke system, or similar arrangement (including cross-server travel, shared accounts, shared economies, shared permissions, shared chat, shared authentication, shared player data, or any other shared service), where any server in the network is itself a Commercial Server, or where the network as a whole provides, supports, enables, or facilitates any Commercial Server characteristics described in this Section 1.4. For avoidance of doubt: "Commercial Server" includes servers that claim to be "non-profit", "at-cost", "donation-only", or "community-funded" if any funds or value are solicited or received in connection with the Server. 1.5 "Commercial License" means a separate written license agreement granted by Developer (or expressly agreed in writing by Developer) authorizing use of the Software on a Commercial Server. 2. LICENSE GRANT (NON-COMMERCIAL) Subject to continuous compliance with this Agreement, Developer grants You a revocable, non-exclusive, non-transferable, non-sublicensable, worldwide license to: 2.1 Use the Software for non-commercial purposes only; and 2.2 Copy and Modify the Software for Your own non-commercial use; and 2.3 Distribute verbatim or Modified copies of the Software solely if ALL conditions in Section 4 are met. 3. COMMERCIAL SERVER RESTRICTION 3.1 NO COMMERCIAL SERVER USE. You must not install, run, access, or use the Software on or for any Commercial Server unless You have obtained a Commercial License in advance from Developer. 3.2 NO CIRCUMVENTION. You must not structure donations, perks, sponsorships, access controls, network arrangements, or other mechanisms in a manner intended to circumvent the definition of Commercial Server. Any reasonable interpretation that the Server confers or seeks material advantage connected to the Server will be treated as Commercial Server use. 4. DISTRIBUTION AND MODIFICATIONS (CREDIT AND LICENSE MUST REMAIN) If You distribute the Software (including Modified versions), You must: 4.1 Provide this Agreement with the distributed Software, unmodified and in full (for example, as a LICENSE file). 4.2 Retain all existing attribution and notices, including: "Copyright (c) 2025 def9a2a4" and "https://github.com/def9a2a4/BlockShips". 4.3 State prominently that Your version is modified (if applicable) and include a clear summary of changes and the date of modification. 4.4 License Your modifications and derivative works under this same Agreement, and impose no additional restrictions that would conflict with it. 4.5 Not represent Modified versions as being authored by Developer. 4.6 NO FEE FOR REDISTRIBUTION. You must not charge any fee or require any consideration (money or otherwise) for distributing the Software (including Modified versions), whether as a direct sale, paid download, access fee, or any other paid gating mechanism. Distribution must be free of charge. 5. OTHER RESTRICTIONS 5.1 NO REMOVAL OF NOTICES. You must not remove, obscure, or alter any copyright, attribution, license, or notice included with the Software. 5.2 NO TRADEMARK LICENSE. This Agreement does not grant any right to use Developer's names, marks, or branding to imply endorsement. 5.3 NO SUBLICENSING. You may not sublicense, rent, lease, sell, or otherwise transfer rights in the Software, except as expressly allowed under Section 2 and Section 4. 6. COMMERCIAL LICENSING 6.1 If You wish to use the Software on a Commercial Server, You must obtain a Commercial License in advance. 6.2 To request a Commercial License, contact Developer via the repository at: https://github.com/def9a2a4/BlockShips 6.3 Developer may grant or deny Commercial Licenses at Developer's sole discretion and may set fees and terms case-by-case. 7. TERMINATION 7.1 This Agreement is effective until terminated. 7.2 Your rights under this Agreement terminate automatically and immediately if You breach any term of this Agreement. 7.3 Upon termination, You must cease all use and distribution of the Software and use reasonable efforts to destroy all copies in Your possession or control, to the extent practicable, except to the extent retention is required by law or copies are retained as part of routine archival or backup systems not reasonably feasible to delete. 8. DISCLAIMER OF WARRANTY THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS, AND WITH NO WARRANTY WHATSOEVER. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEVELOPER DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. YOU ASSUME ALL RISK ARISING OUT OF USE OR PERFORMANCE OF THE SOFTWARE. 9. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DEVELOPER BE LIABLE FOR ANY DAMAGES WHATSOEVER ARISING OUT OF OR RELATED TO THE SOFTWARE OR THIS AGREEMENT, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY OF LIABILITY, INCLUDING WITHOUT LIMITATION ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL; ANY BUSINESS INTERRUPTION; ANY COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; OR ANY CLAIMS BY THIRD PARTIES. WITHOUT LIMITING THE FOREGOING, DEVELOPER WILL NOT BE LIABLE FOR ANY DAMAGE TO OR LOSS OF COMPUTER EQUIPMENT, HARDWARE, SOFTWARE, NETWORKS, SYSTEMS, OR DATA, INCLUDING WITHOUT LIMITATION DATA STORED ON THE SERVER, CLIENT MACHINES, BACKUPS, OR ANY OTHER COMPUTERS OR SERVICES, OR FOR ANY SECURITY INCIDENTS, SERVICE OUTAGES, OR CORRUPTION OR DELETION OF DATA. THIS LIMITATION APPLIES REGARDLESS OF WHETHER ANY PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR WHETHER SUCH DAMAGES WERE FORESEEABLE. 10. COMPLIANCE WITH THIRD-PARTY TERMS You are solely responsible for compliance with any applicable third-party terms, including without limitation Minecraft EULA / Microsoft / Mojang terms and any hosting provider terms. 11. SEVERABILITY If any provision of this Agreement is held invalid or unenforceable, the remaining provisions will remain in full force and effect. 12. ENTIRE AGREEMENT This Agreement constitutes the entire agreement between You and Developer regarding the Software and supersedes all prior or contemporaneous agreements or communications. END OF TERMS
