DEFINITIONS "Software" means HAMAL, including its source code, object code, documentation, configuration, assets, and substantial portions thereof. "Derivative Work" means a modified version of the Software or a work substantially based upon the Software. "Organization" means a company, business, government entity, educational institution, non-profit organization, or other legal entity. "Internal Organizational Use" means use of the Software by an Organization for its own internal operations, employees, contractors, infrastructure, systems, and business processes, where the Software is not offered as a product or service to third parties. "Commercial Distribution" means selling, licensing, sublicensing, renting, leasing, reselling, or otherwise providing the Software or a Derivative Work to third parties for monetary compensation or commercial advantage. "Commercial Service" means providing the functionality of the Software to third parties as a paid or revenue-generating service, including SaaS, hosted services, managed services, APIs, file-transfer services, or substantially similar offerings. 2. GRANT OF RIGHTS Subject to the terms of this License, the Copyright Holder grants you a worldwide, non-exclusive, royalty-free license to: a. use the Software; b. study and inspect the source code; c. modify the Software; d. create Derivative Works; e. create private forks; f. reproduce and internally distribute the Software and Derivative Works; g. deploy the Software and Derivative Works within your own infrastructure. These rights are granted for personal use, educational use, research, testing, evaluation, and Internal Organizational Use. 3. INTERNAL ORGANIZATIONAL USE Organizations are expressly permitted to use HAMAL for their own internal business and operational purposes, including commercial business operations. An Organization may: a. install HAMAL on its own servers, workstations, or infrastructure; b. use HAMAL with its employees, contractors, and authorized personnel; c. modify HAMAL to meet its own operational or technical requirements; d. create private internal forks of HAMAL; e. modify the user interface, branding, configuration, integrations, workflows, and functionality for internal use; f. deploy modified versions throughout its own organization; g. use HAMAL as part of its normal internal commercial operations. Internal Organizational Use is permitted regardless of whether the Organization itself operates for profit. 4. PRIVATE MODIFICATIONS An Organization may modify HAMAL for Internal Organizational Use without being required by this License to publish, disclose, or contribute those modifications to the Copyright Holder or to the public. Private modifications remain permitted provided that the modified Software is not Commercially Distributed or offered as a Commercial Service to third parties. 5. PROHIBITED COMMERCIAL USE Without prior written permission from the Copyright Holder, you may NOT: a. sell HAMAL or a Derivative Work as software; b. license or sublicense HAMAL or a Derivative Work to third parties; c. offer HAMAL or a Derivative Work as a commercial software product; d. rebrand, rename, substantially modify, or otherwise create a substantially equivalent commercial product based on HAMAL and distribute that product to third parties; e. incorporate substantial portions of HAMAL into a commercial software product that is distributed to third parties; f. commercially distribute HAMAL or a Derivative Work; g. offer HAMAL or a Derivative Work as a paid SaaS, hosted, managed, cloud, API, file-transfer, synchronization, storage, or similar service to third parties; h. charge customers specifically for access to HAMAL or functionality substantially derived from HAMAL; i. use HAMAL as the underlying software for a commercial service where access to the Software or its substantially derived functionality is itself part of the commercial offering. 6. PROFESSIONAL SERVICES This License does not prohibit ordinary professional services performed around HAMAL. For example, an Organization or service provider may provide: - installation assistance; - configuration assistance; - system administration; - technical support; - consulting; - training; - infrastructure management. Such services are permitted provided that the provider is not selling, licensing, or commercially distributing HAMAL itself or a Derivative Work as a software product or service. 7. THIRD-PARTY USE Internal Organizational Use does not include making HAMAL available to customers, clients, external organizations, or members of the public as a product or service. An Organization may use HAMAL internally even when that Organization generates revenue through its normal business activities. However, providing HAMAL or a Derivative Work to third parties as part of a paid or revenue-generating software offering requires separate written permission from the Copyright Holder. 8. REDISTRIBUTION Non-commercial redistribution is permitted provided that: a. this License is included; b. copyright and attribution notices are preserved; c. the recipient receives the same rights and restrictions; d. the redistribution does not constitute Commercial Distribution. Commercial redistribution requires a separate written license from the Copyright Holder. 9. TRADEMARKS AND BRANDING This License does not grant rights to the HAMAL name, HAMAL logos, i1K3R Labs branding, trademarks, service marks, or other brand assets. You may not use HAMAL branding in a manner that falsely suggests that a modified or redistributed version is an official HAMAL product. Internal Organizations may modify or replace branding for their own private internal deployments. 10. COMMERCIAL LICENSE Commercial product distribution and Commercial Services may be permitted under a separate written commercial license issued by the Copyright Holder. All rights not expressly granted by this License are reserved by the Copyright Holder. The public availability of the source code does not grant rights beyond those expressly provided by this License. 12. TERMINATION The rights granted under this License automatically terminate upon a material violation of its terms. Upon termination, the violating party must cease the prohibited use, distribution, or commercial exploitation of the Software or applicable Derivative Work. Rights unrelated to the violation remain unaffected where permitted by applicable law. 13. NO WARRANTY THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. IN NO EVENT SHALL THE COPYRIGHT HOLDER BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY ARISING FROM THE USE OF THE SOFTWARE. 14.
