MarkWatch IN - Privacy Policy Publisher: LeonS Contact: atulhritik@hotmail.com Applies to the Apify Actor "India Trademark Journal Watch - MarkWatch IN". Public address of this text: https://raw.githubusercontent.com/leons0016/ADApps/main/privacy/P1-MarkWatchIN.txt 1. What the Actor processes - Public data from the Trade Marks Journal published by the Office of the Controller General of Patents, Designs and Trade Marks: application number, filing date, mark text, class, goods or services, applicant name, the city and state of the applicant, agent name (when printed), used-since date, registry office, Journal number and date. The street address of an applicant is never stored or output. - The data you give the Actor: your watch-list (marks, classes, references), your settings and, if you set them, a watch-list file address, a webhook address and a Slack webhook address. 2. Where the data lives - Your watch-list, your results and your history stay in your own Apify account (the run's dataset and key-value store, and the named key-value store "leons-markwatch-state"). The publisher does not receive your watch-list and has no server that stores it. - The publisher keeps one shared key-value store of parsed Journals. It contains public Journal data only, never customer data. Your runs only read from it. 3. Retention - The history record in your state store is pruned after 400 days. You can delete that store, the task and the run datasets yourself at any time. - Datasets and key-value stores of runs follow the retention rules of your Apify plan. 4. Billing and processors - Apify bills you and acts as the processor for billing and for running the Actor. The Actor has no payment or account data of its own. 5. Sources, politeness and secrets - The Actor reads public documents only, checks robots.txt, identifies itself in its User-Agent, does not log in, does not solve CAPTCHAs and does not search by person. - The Slack webhook address is stored as a secret input and is never written to the logs, the dataset or the reports. 6. Purpose and legal note - The Journal is a statutory public notice. The Actor reduces the data to what is needed to compare marks and to show the opposition deadline. Whether the Digital Personal Data Protection Act 2023 applies to your own use of the results is for you and your counsel to decide. The results are a screening signal, not legal advice. 7. Your rights and questions - Write to atulhritik@hotmail.com to ask about this policy or to report a data problem.
