(hereinafter referred to as 'FWOOPS') hereby reminds you that before using FWOOPS's hardware and software products, you should read and comply with the User Agreement (hereinafter referred to as 'this Agreement'). Please be sure to read carefully and fully understand the terms and conditions. Unless you have read and accepted all the terms and conditions of this Agreement, you are not authorized to use FWOOPS-branded hardware and software products. If you proceed by entering the program and selecting 'Agree and Continue', it will be deemed that you have accepted this agreement and agreed to be bound by its terms. If you have not reached legal adulthood, your legal guardian will need to agree or sign this agreement, with special attention paid to the terms for minors. 1 Scope of the agreement 1.1 This agreement is a contract between the user (hereinafter referred to as 'you') and FWOOPS regarding the use of FWOOPS's hardware and software products and other related matters. 1.2 You expressly declare and guarantee that you have sufficient legal rights or authorization to sign and fulfill the terms of the FWOOPS User Agreement; your signing and fulfilling of the FWOOPS User Agreement will not conflict with any other agreements or arrangements to which you are obligated, nor will it result in a breach of contract. To use FWOOPS products, if you encounter obstacles including but not limited to the following: not reaching full civil liability status, not obtaining valid authorization, conflicts between this agreement and your other statutory or contractual obligations, etc., please thoroughly eliminate the obstacles and restore your eligibility to sign and fulfill the agreement first. 1.3 You also guarantee that the terms of the FWOOPS User Agreement are legally binding on you and enforceable when necessary. To use FWOOPS products, you must be of legal age, therefore, using FWOOPS products is deemed as your acknowledgment that you are older than the legal age. If you are under the legal age, before deciding whether to use FWOOPS products, please read the terms of this agreement with your parents or legal guardian to ensure that they fully understand the content of the terms. We recommend that parents or legal guardians provide supervision and guidance to their underage children when using FWOOPS products. 2 FWOOPS services are provided to you in two ways: one is to provide you with FWOOPS services as easily as possible when you use your FWOOPS products; The other is the FWOOPS service over the Internet. Depending on the FWOOPS products you own, the services provided by FWOOPS may vary, and not all featured services are available. Please refer to the user manual of your product for specific details. 3 Software updates 3.1 In order to achieve timely repair of user issues and improve user experience, we will collect information on the type, model, system and software version numbers, MAC addresses, and IP addresses of FWOOPS hardware devices to provide you with software upgrade notifications and automatic update functions. 3.2 FWOOPS devices provide you with online software updates, including but not limited to updating or upgrading code and other embedded software, documents, interfaces, content, fonts, and any data stored on FWOOPS devices. This update or upgrade requires a network connection, and any data fees that may be incurred due to networking will be directly charged by the operator. For details, please consult your operator. If you need to disable this feature, you can set it up in the system by logging into the management interface. However, please be aware that disabling this feature will not automatically upgrade the software system of your FWOOPS device. When manually upgrading, it may be difficult for you to determine the current compatible software version of the device in a timely manner, which may affect your product experience. 3.3 In emergency situations, FWOOPS will download and install important update software for your device to ensure its stable operation. This feature is enabled by default on some devices. If you need to disable this feature, you can set it to turn off cloud services in the system by logging into the management interface. 3.4 During the upgrade process, if there is a power outage or a very low probability of hardware failure, it may cause the device system to fail to start normally and automatically enter recovery mode. In recovery mode, the default is to use the network settings you used when browsing the internet normally, in order to download software from the server to complete the repair. We will fix it with the latest updated software version. 3.5 You understand and agree that the specific service content of this upgrade service will be provided to you by FWOOPS according to the 'current situation' and 'existing'. FWOOPS has the right to determine the form and specific content of software update services on its own, and FWOOPS has the right to change, suspend, or terminate part or all of this upgrade service on its own. 4 Management FWOOPS products support management functions, and devices can be connected to the FWOOPS cloud platform to achieve remote management services. If you use the platform management function to connect your device, there are corresponding 'user agreements' and 'personal information protection policies' for the WEB entrance, client entrance, and mobile APP entrance of the relevant platform services. Please read the relevant agreements and policies first. If you choose 'agree and continue', it will be deemed that you accept such agreements and policies and agree to be bound by the terms of the agreements and policies. The relevant agreements and policies are based on the principles of consistent rights and responsibilities, clear objectives, selective consent, minimum necessity, ensuring security, subject participation, openness and transparency, and other personal information processing principles. 5. Login password reset If you forget your login password and are unable to log in normally, you can reset your FWOOPS ID password in the relevant software of FWOOPS. 6 Responsibility assumption 6.1 You understand and agree that as the user of FWOOPS, you shall bear all responsibilities arising from all activities under this FWOOPS. 6.2 FWOOPS may restrict, freeze or terminate your use of FWOOPS in accordance with the user agreement, which may cause you certain losses. You shall bear the losses on your own, and FWOOPS shall not be liable for any responsibility. 6.3 You are not allowed to transfer FWOOPS for a fee or free of charge to avoid disputes. You shall bear any responsibility arising from this on your own, and FWOOPS reserves the right to pursue legal responsibility against the above-mentioned parties. 7 User Behavior Standards 7.1 You shall not maliciously use FWOOPS. FWOOPS can independently judge and handle malicious usage behavior. 7.2 The right to use FWOOPS belongs only to the registered individual. Without the permission of FWOOPS, you are not allowed to give, borrow, rent, transfer or sell FWOOPS, or otherwise license non initial registrants to use FWOOPS. 7.3 If the FWOOPS you are currently using is not yours or obtained through other means provided by FWOOPS, but you are aware of the current password of the FWOOPS, you are not allowed to log in or perform any operations using the FWOOPS, and please notify FWOOPS or the initial registrant of the FWOOPS as soon as possible. 7.4 You may use FWOOPS services within the scope of this agreement, and you shall not engage in the following activities using FWOOPS's related websites, software, etc.: (1) copying, changing, reverse engineering, reverse assembly, reverse compilation, etc. to analyze or copy the modified source code, structure, concept, etc. of FWOOPS; (2) The act of creating false identities, misleading, or deceiving others; (3) Using FWOOPS services to publish, transmit, spread, and store content that endangers national security, national unity, and social stability, or insulting, defaming, pornographic, violent, causing others to feel uneasy, or any content that violates national laws, regulations, and policies, or setting up usernames or character names containing the above content, publishing, transmitting, and disseminating advertising information, marketing information, and junk information containing the above content; (4) Engaging in any behavior that endangers computer network security, including but not limited to: using unauthorized data or accessing unauthorized servers/accounts; Unauthorized access to public computer networks or other people's computer systems and deletion, modification, or addition of stored information; Attempting to explore, scan, test vulnerabilities in FWOOPS services or networks without permission, or engaging in other activities that undermine network security; Attempting to interfere with or disrupt the normal operation of systems or networks, intentionally spreading malicious programs or viruses, and other behaviors that disrupt or interfere with normal network information services; (5) Engaging in behaviors prohibited by other laws, regulations, policies, public order, good customs, and social ethics, as well as behaviors that infringe upon the legitimate rights and interests of other individuals, companies, social groups, and organizations. 7.5 You fully understand and agree that you shall be responsible for all actions under the FWOOPS you have registered, including any content you publish and any consequences arising therefrom. At the same time, you should understand and agree that FWOOPS cannot control your usage behavior, but FWOOPS has the right to refuse to provide services for illegal or infringing usage behavior. Therefore, if FWOOPS discovers or receives complaints or reports that your usage behavior does not comply with laws and regulations or does not comply with this agreement, it has the right to independently determine your behavior and applicable rules, and handle them accordingly, including warning, refusal to publish, deletion of information, restriction of functions, suspension of updates, suspension of services, termination of services until account closure, reporting to relevant regulatory departments or national authorities, requiring you to compensate for losses, etc., and keeping relevant records; If your aforementioned actions result in any third party making a claim, you shall also be solely responsible. In addition, you should be aware and understand that in addition to the information provided by the complainant or informant, our system records may also serve as relevant evidence of your violation of the law or this agreement. 7.6 If you discover that other users have uploaded or published illegal or infringing content that violates the law or this agreement while using FWOOPS services, you can directly contact us and we will verify and handle it as soon as possible 8 Fees You expressly acknowledge and agree that FWOOPS has the right to charge fees for the service or change the price of the service. If effective laws and regulations require prior notice to the user, FWOOPS will notify you at a reasonable time in advance. After the new charging price takes effect, you will need to accept the updated new price in order to continue using this service. If you do not agree to change the fee, you have the right to terminate the use of the corresponding service before the fee change. Unless otherwise agreed, all the above fees do not include any taxes and fees, and you shall pay any taxes and fees required by law in accordance with the law. 9 FWOOPS respects and is committed to protecting your privacy rights. For detailed information on how we collect and use your personal information, please refer to our published Privacy Policy. 10 Intellectual Property Rights 10.1 Unless otherwise specified, the intellectual property rights of the content provided by FWOOPS in this service (including but not limited to web pages, text, images, audio, video, charts, etc.) belong to FWOOPS. 10.2 Unless otherwise specified, the copyright, patent, and other intellectual property rights of the software relied upon by FWOOPS for providing this service belong to FWOOPS. 10.3 The intellectual property rights of the above-mentioned and any other content included in this service are protected by law. Without written permission from FWOOPS and relevant rights holders, no one may use or create related derivative works in any form. 11. Products or services provided by third parties Some content, components, or functions of the service may come from third-party materials and links. You understand and accept that the third party shall be responsible for resolving any direct or indirect damages caused or potentially caused to you by services that involve or rely on third-party information. 12 Scope and Limitations of Liability 12.1 FWOOPS makes no express or implied representations or warranties, including but not limited to merchantability, merchantability, fitness for a particular purpose, or non infringement of any rights. FWOOPS makes no special guarantees for the following situations: (1) This service will meet your specific needs; (2) This service will be provided uninterrupted, timely, secure, or defect free; (3) Any information obtained during your use of the service is accurate or reliable; (4) Any defects or errors in any software that is part of the service will be corrected. 12.2 In view of the particularity of Internet services, you understand and agree that FWOOPS services may be affected by many factors, including but not limited to: (1) You have violated regulations or operated improperly, resulting in the inability to use FWOOPS basic services, or due to your choice to disable specific functions or not authorize FWOOPS to collect your information for specific functions, resulting in the inability to use FWOOPS extended services; (2) FWOOPS services cannot operate normally due to force majeure factors such as typhoons, earthquakes, tsunamis, floods, power outages, wars, terrorist attacks, sudden public health emergencies, network failures, etc; (3) Due to changes in laws and regulations, orders and judgments from judicial and administrative authorities, FWOOPS services cannot be used normally; (4) Affected by various security issues, such as others illegally using user data and engaging in real-life harassment; (5) Users downloading and installing other software or accessing other websites may contain viruses, Trojan programs, or other malicious programs that threaten the security of your terminal device information and data, thereby affecting the normal use of FWOOPS products. 12.3 FWOOPS and its affiliates, subsidiaries, managers, directors, employees, agents, partners, and licensors shall not be liable to you for any direct, indirect, incidental, special, derivative, or punitive damages, including but not limited to loss of profits, loss of goodwill, and other intangible losses (even if FWOOPS has been informed of the possibility of such damages), in the following circumstances: (1) Use or inability to use this service; (2) Changes to the service, any temporary or permanent cessation of all or part of the service; (3) Unauthorized access or alteration of your transmission or data; (4) Delete, destroy, or fail to store and/or send or receive your transmissions or data through the service; (5) Any third-party statements or actions in the service; (6) Your violation of the provisions of this agreement; (7) Any other matters related to this service. 12.4 You fully understand and agree that in order to improve the quality of service, FWOOPS service provides you with a channel for providing feedback on abnormal information. You can choose to submit the content you need to provide feedback to FWOOPS on your own. Please be sure to note that the submitted content must not violate national laws and regulations, infringe on the intellectual property rights, portrait rights, reputation rights, personal privacy or other legitimate rights and interests of others. Otherwise, you will be solely responsible for relevant legal liabilities. 13 General Terms and Conditions 13.1 If any part of this agreement is deemed invalid by a court or other competent authority, the other provisions shall not be affected and shall continue to be binding and enforceable on both parties to the maximum extent permitted by law. The titles of the clauses in this agreement are for convenience only and do not have legal or contractual effect. FWOOPS may distribute its obligations under this Agreement at any time without prior notice. But you shall not distribute, transfer or sublicense the obligations under this agreement. 13.2 You agree that if FWOOPS does not require the realization or enforcement of any legal rights or remedies under this Agreement, this does not mean that FWOOPS waives these rights or remedies, and FWOOPS still reserves the right to exercise these rights. These terms (including the privacy policy, user manual (if you use FWOOPS's network devices), and any other legally established terms) constitute the entire agreement between you and FWOOPS regarding the use of this service. This agreement shall supersede all prior oral or written agreements between you and FWOOPS regarding this service. 14 Termination of Agreement 14.1 If any of the following situations occur, FWOOPS has the right to interrupt or terminate the services provided to you without notice: (1) You violate relevant laws and regulations or the provisions of this agreement; (2) According to legal regulations or requirements of competent authorities; (3) For safety reasons or other necessary circumstances. 14.2 FWOOPS has the right to charge fees in accordance with the provisions of Article 4 of this Agreement. If you fail to pay in full and on time, FWOOPS has the right to interrupt, suspend or terminate the provision of services. 14.3 After your service is terminated, FWOOPS may permanently delete your data from the server, except as otherwise provided by laws and regulations. After the service is terminated, FWOOPS is not obligated to return the data to you. 14.4 After the termination of your service, you will not be exempted from the obligation to pay any fees that should have been paid before (including) the termination date, and FWOOPS and any third party shall not be liable for the consequences of your inability to obtain this service after the termination of your service. Article 7 and Articles 9-14 of this Agreement shall remain in effect after the termination of this Service or this Agreement. 15 Applicable Law Jurisdiction 15.1 The establishment, effectiveness, performance, interpretation, and dispute resolution of this agreement shall be governed by the laws of mainland China. 15.2 This agreement is signed in Nanshan District, Shenzhen City, Guangdong Province, People's Republic of China. You and FWOOPS agree that any and all disputes, claims, and claims arising from the performance of this agreement and the acceptance of services under the terms of this agreement shall be resolved through friendly negotiation first; If the negotiation fails, both parties agree to submit the dispute or controversy to the people's court with jurisdiction over the place where this agreement is signed. During the litigation process, both parties will continue to perform other parts of this agreement that are not subject to litigation. 16 Integrity of Protocol 16.1 Unless otherwise agreed, prior to entering into this Agreement, the parties have not relied on any oral or written agreements, discussions, communications, agreements, representations, warranties, advertisements, etc. other than those expressly provided for in this Agreement. 16.2 Prior to the effective date of this Agreement, no oral or written negotiations shall be construed as giving or implying any statement, promise, or commitment. Even if you believe that any untrue statement made by FWOOPS has led you to rely on that statement to sign this agreement, you do not have any remedies (unless the statement is made for fraudulent purposes). 16.3 You and FWOOPS are independent entities, and reaching this agreement does not imply any cooperation, joint venture, or agency relationship between you and FWOOPS. At the same time, FWOOPS's affiliates, as beneficiaries of this agreement, have the right to exercise the rights of the parties to this agreement. 16.4 FWOOPS's branches, subsidiaries, licensors, and suppliers are third-party beneficiaries of this agreement and may enforce this agreement as parties to it. 17 Protocol Update FWOOPS may update or modify the terms of this agreement from time to time. For adjustments or updates, we will announce or notify you through internal announcements, internal messages, emails, or other means. If you do not accept significant adjustments or updates, you should immediately cease all use of the service and notify us in writing. We will handle termination related matters with you in accordance with the user agreement prior to the update. You understand that when you obtain services from a third party, you may request to accept the terms of the third party's agreement, including but not limited to the terms of your communication operator's agreement.
