# Terms of Use

Please read these Terms of Use ("Terms") carefully before using the SolarWise mobile application (the "App") operated by FroggyEye ("we", "our", or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

## 1. Description of Service

SolarWise is a solar panel calculator that provides estimated solar energy generation, battery sizing, and financial projections based on user-provided inputs and publicly available solar irradiance data from NASA. The App is a planning tool intended to help homeowners evaluate solar energy options.

## 2. Disclaimer of Financial Advice

**THE APP DOES NOT PROVIDE FINANCIAL, INVESTMENT, TAX, OR LEGAL ADVICE.**

All calculations, projections, savings estimates, break-even timelines, and return-on-investment figures are estimates based on simplified models and general assumptions. Actual results will vary based on:

- Local weather conditions and microclimate
- Actual equipment specifications and installation quality
- Electricity rate changes and utility policies
- Government incentive changes
- Equipment degradation and maintenance
- Installer pricing and labor costs
- Permit and interconnection requirements

**You should consult a certified solar installer, financial advisor, and/or tax professional before making any solar energy investment decisions.** We are not responsible for any financial decisions made based on the App's estimates.

## 3. Accuracy of Data

- **NASA POWER data**: Solar irradiance data is sourced from NASA's POWER API, which provides satellite-derived estimates. These are historical averages and may not reflect future conditions.
- **Regional defaults**: Default electricity rates, installation costs, tax incentives, and feed-in tariffs are approximate and may not reflect current rates in your area. Always verify with your local utility and government agencies.
- **Calculation models**: Our models use industry-standard assumptions for panel degradation, inverter efficiency, temperature coefficients, and battery degradation. These are simplifications of complex real-world systems.

We make reasonable efforts to keep data accurate but do not guarantee the accuracy, completeness, or timeliness of any information provided by the App.

## 4. In-App Purchases

### SolarWise Pro
- SolarWise Pro is available as a one-time, non-consumable in-app purchase.
- Once purchased, Pro features are permanently unlocked on the device and Apple ID or Google account used for the purchase.
- You may restore your purchase on a new device using the "Restore Purchase" function.

### Payment
- Payment is processed by Apple (App Store) or Google (Google Play), not by us.
- Pricing is set in the respective stores and may vary by region.
- All purchases are subject to the terms of your Apple or Google account.

### Refunds
- Refund requests must be directed to Apple or Google, as they process all payments.

## 5. Free Tier and Advertising

The free tier of SolarWise includes advertisements served by Google AdMob. By using the free tier, you consent to the display of advertisements. Ad content is determined by Google and is subject to Google's advertising policies.

## 6. Intellectual Property

The App, including its design, code, calculations, text, graphics, and user interface, is owned by FroggyEye and protected by applicable intellectual property laws. You may not:

- Copy, modify, or distribute the App or its content
- Reverse engineer, decompile, or disassemble the App
- Use the App for commercial purposes beyond personal solar planning
- Remove or alter any proprietary notices

## 7. User Responsibilities

You agree to:
- Provide accurate information when using the calculator
- Use the App for lawful purposes only
- Not attempt to circumvent in-app purchase mechanisms
- Not interfere with the App's operation or security

## 8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

- THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
- WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY).
- WE ARE NOT LIABLE FOR ANY LOSSES RESULTING FROM SOLAR INVESTMENT DECISIONS MADE BASED ON THE APP'S ESTIMATES.

## 9. Third-Party Services

The App connects to third-party services (NASA POWER API, Google AdMob, Apple StoreKit, Google Play Billing). We are not responsible for the availability, accuracy, or practices of these services. Your use of these services is subject to their respective terms and privacy policies.

## 10. Modifications

We reserve the right to modify, update, or discontinue the App at any time without notice. We may also update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

## 11. Termination

We may terminate or suspend your access to the App at any time for violation of these Terms. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall survive (including Limitation of Liability and Intellectual Property).

## 12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or the App shall be resolved in the courts of England and Wales.

## 13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
