# Customs edge cases These are hypothetical review patterns, not actual rulings or verified duty rates. Each outcome depends on the transaction date, jurisdiction and evidence. 1. **Low-value parcel restructuring.** Do not use the historical $800 rule as a current duty-free route. Check CBP's operative entry procedure and restrictions for the shipment date. Do not split, undervalue or misidentify importers to evade duties. Incoterms/title/control alone do not decide importer status; product-agency requirements remain separate from a duty exemption. 2. **Suspected AD/CVD transshipment.** Hold affected decisions for trade counsel and preserve production records, BOM, supplier history and exact order scope. EAPA addresses AD/CVD evasion; Section301 alone is not an AD/CVD order. Do not invent a combined AD/CVD rate from one AD case number, a 30% origin threshold or a guarantee that assembly/three changed characteristics settles scope. 3. **EAR/ITAR uncertainty.** Analyse the actual configured item under the correct regulations and specially-designed definitions, which are not interchangeable. Generic commercial availability, five axes or ±2microns do not independently prove an ECCN or USML category. Seek qualified jurisdiction/classification review and a formal determination where appropriate. Do not export or release controlled technical data pending the necessary clearance; no promised CJ or licence turnaround, automatic dual-regime violation or invented exception. 4. **Year-end related-party adjustment.** Map adjustments to affected merchandise and examine the original pricing policy, customs acceptability, reconciliation status and procedural deadlines. A tax reduction is not automatically a refund entitlement, and a reconciliation is not automatically a prior disclosure. Present estimated duty effects only after classification/rate verification. 5. **Multi-tier first sale.** Establish a bona fide sale for export, documentary chain and arm's-length acceptability, plus actual statutory adjustments. Do not equate any buying agent with a reseller, every design with an assist or a particular markup with failure. Verify each jurisdiction's rule; do not invent a worldwide country whitelist or savings threshold requiring a ruling. 6. **Missed USMCA preference.** Verify origin for each production period and the permitted evidence. Under1520(d), calculate one year from importation, not liquidation. A generic180-day protest cannot be assumed to rescue an expired claim. Separate estimated overpayment from legally recoverable and collected amounts. Do not infer a finished assembly's classification from its inputs. 7. **Carnet goods proposed for sale.** Stop unapproved diversion from the admitted purpose. Ask customs/broker and the guaranteeing association about authorised conversion/discharge or re-export before delivery. Do not assume conversion is always forbidden or that filing a retroactive entry fixes everything. Medical device marketing/clinical-use approval is independent of duty status. 8. **Coffee kit classification.** Evaluate actual components, domestic/commercial appliance characteristics, retail presentation, need/activity and essential character. A branded box, highest-value component or separately marketable goods are not decisive alone. Classification must precede duty optimisation; check food-agency obligations independently. Do not invent codes, rates or a future trade agreement to make the preferred answer economical. 9. **False origin marking.** Preserve facts, stop repeating inaccurate declarations and seek counsel on origin, marking, applicable additional duty and corrections. Section301 duties are distinct from AD/CVD/EAPA. Do not equate invoice value with domestic value, add incompatible maximum penalties or promise disclosure protection from a single notice-date shortcut. Correct marks and records under the authorised procedure, without destroying evidence or inventing culpability. 10. **Forced-labour detention.** Preserve shipment-specific upstream traceability, production/payment records and actual notice deadlines. Distinguish a claim that goods are outside UFLPA scope from a request to overcome its presumption. The presumption includes covered entities, not only geographic inputs; there is no general small-percentage exemption. Do not declare an exception legally impossible, promise routine extensions, treat a voluntary certification or isotope test as conclusive, or automatically divert goods to another market. Counsel must assess the permitted response, evidence, reporting and disposal. ## Worked calculation boundaries For a purely hypothetical 19.7% rate and values12.50 versus9.80, the difference is 2.70×0.197=0.5319 per unit, or1,063,800 for2,000,000 units before programme costs. This arithmetic is not proof that the rate, first-sale eligibility, adjustments or refund are valid. Use current official authorities and qualified review.
